Terms of Service

Effective date: January 1, 2025

These Terms of Service ("Terms") govern your access to and use of the MilSpecWellness telehealth platform operated by MilSpecWellness LLC ("we," "us," "our"). By creating an account or using our services, you agree to these Terms.

1. Eligibility

You must be 18 years or older and a legal resident of a state in which we are licensed to practice. You must provide accurate and truthful information during intake and throughout your care.

2. Nature of services

MilSpecWellness provides telehealth evaluations, prescriptions when clinically appropriate, and ongoing care management. We are not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911.

3. Provider-patient relationship

A provider-patient relationship is established only after a licensed provider accepts you as a patient following a video evaluation. Submission of intake information alone does not create a provider-patient relationship.

4. Prescriptions

Prescriptions are issued at provider discretion based on clinical judgment. We do not guarantee any specific treatment, prescription, or outcome. Controlled substances are prescribed in accordance with applicable federal and state law and may require in-person evaluation depending on jurisdiction.

5. Payment

Services are billed on a subscription basis. Charges are billed in advance for the upcoming month. You may cancel anytime effective at the end of the current billing cycle. Refunds are considered case-by-case.

6. Off-label use disclosure

Some medications, including certain peptides, are prescribed for uses not approved by the FDA. Your provider will discuss off-label use, evidence, and risks during your visit.

7. User conduct

You agree not to: misrepresent your identity, misuse the platform, share prescriptions with others, or attempt unauthorized access to other patients' records.

8. Intellectual property

All site content, branding, and educational materials are property of MilSpecWellness LLC.

9. Limitation of liability

To the fullest extent permitted by law, our liability is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

10. Arbitration

Disputes will be resolved by binding arbitration under the American Arbitration Association's rules, except for claims that may be pursued in small claims court or involve injunctive relief.

11. Termination

We may suspend or terminate service for nonpayment, misrepresentation, or violation of these Terms. You may discontinue service at any time.

12. Governing law

These Terms are governed by the laws of the state in which MilSpecWellness LLC is organized, without regard to conflict of laws principles.

13. Changes

We may update these Terms. Continued use after changes constitutes acceptance.
