Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MilSpecWellness platform operated by MilSpecWellness LLC ("we," "us," "our"). By creating an account or using our services, you agree to these Terms.

1. Eligibility

You must be 18 years or older to use the platform. You must provide accurate and truthful information during intake and throughout your engagement with our coaching team.

2. Nature of services

MilSpecWellness provides personal training programming, nutrition coaching, and accountability services. We do not provide medical services of any kind. We do not diagnose, treat, cure, or prevent any disease. If you are experiencing a medical emergency, call 911.

3. Coaching relationship

A coaching relationship is established only after intake completion and acceptance by our team. Creating an account or submitting intake information alone does not create a coaching relationship.

4. Programs and outcomes

Coaching programs are built by our team based on your stated goals, intake responses, and ongoing check-ins. We do not guarantee any specific outcome, weight change, or performance result. Results depend on adherence, consistency, and individual factors.

5. Payment, refunds, and subscriptions

Coaching is billed via Stripe at the time of checkout. Subscription terms (if applicable) are presented clearly at checkout.

Refunds: Considered case-by-case. No refunds are available for coaching services already rendered. If a program isn't a fit, contact the team and we'll work with you.

6. Health considerations

Always consult a licensed medical professional before starting a new fitness or nutrition program, especially if you have any pre-existing conditions, injuries, or are taking medication. You are responsible for disclosing relevant health information in your intake and updating it as needed.

7. User conduct

You agree not to: misrepresent your identity, misuse the platform, share program materials with others, or attempt unauthorized access to other members' records.

8. Intellectual property

All site content, branding, programming, and educational materials are property of MilSpecWellness LLC.

9. Limitation of liability

MilSpecWellness LLC provides personal training and nutrition coaching only. To the fullest extent permitted by law, MilSpec's liability is limited to fees paid for coaching services in the 12 months preceding any claim. We are not liable for indirect, consequential, or incidental damages.

10. Dispute resolution

The Parties shall first attempt in good faith to resolve any dispute through direct negotiation for a period of fifteen (15) days following written notice of the dispute. If the dispute is not resolved through negotiation, it shall be finally resolved by binding arbitration conducted in accordance with the then-current Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Tulsa, Oklahoma. The arbitral award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party irrevocably waives any right to a trial by jury for any legal action arising out of or relating to these Terms.

11. Termination

We may suspend or terminate service for nonpayment, misrepresentation, or violation of these Terms. You may discontinue service at any time. Cancellation does not entitle you to refunds for services already rendered or programs already filled.

12. Governing law

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict of laws principles.

13. Changes

We may update these Terms. Continued use after changes constitutes acceptance.
